Local Laws and Permits

Council's Local Laws cover a range of rules governing how we live in our community. For example, these include the safety of people and property, animals, the land, general amenity, burning and waste disposal. 

There are two sets of Local Laws that you'll find on this page, the Governance Local Law and the Community Local Law.

Governance Local Law

The objectives of the Governance Local Law are to

  • regulate the use of the Common Seal
  • prohibit unauthorised use of the Common Seal or any device resembling the Common Seal
  • provide for the penalties in relation to the conduct of Council Meetings and Delegated Committees

Community Local Law

The objectives of the Community Local Law are to provide for

  • the peace and order of the municipality
  • a safe and healthy environment so that our community can enjoy a quality of life that meets its expectations
  • the safe enjoyment and fair use of public places
  • the protection of Council property
  • the amenity and environment of the municipality
  • the reasonable use and enjoyment of private land

At its Ordinary Meeting on 25 March 2020, Council resolved to adopt a new Local Laws, the 'Community Local Law 2020'. This law is now in effect and can be viewed by clicking on the link below.

  • street stalls
  • car rallies
  • roadside grazing
  • road closures
  • firewood collection
  • alfresco dining
  • displaying goods on a footpath
  • burning off
  • shipping containers

Local law permit - short term activity application

The Community Local Law 2020 requires a permit for certain activities to be undertaken on Council land.

Stalls or events held in front of a business require the business owner’s written consent.

Please note that raffles in Victoria may only be conducted by organisations that have been declared a genuine community or charitable organisation.

Organisations wishing to apply for a declaration can contact the Victorian Commission for Gambling and Liquor Regulation on 1300 182 457 or visit www.vcglr.vic.gov.au.

If you intend setting up a food stall you will also need to apply online via FoodTrader at foodtrader.vic.gov.au.

To allow sufficient processing and production time, please submit your application a minimum of 14 days prior to your event.

General Conditions:

  • The site will only be used for the uses applied for and approved by Council. 
  • Any licence fee must be paid prior to the issue of the permit. 
  • The permit holder will keep the site tidy, clean up after use and not erect any unauthorised structures. 
  • The permit holder will not carry out any dangerous practice, nuisance or offensive behaviour that might interfere with any other persons. 
  • The permit holder agrees that should a permit be granted they will conduct the use of the site at their own risk. 
  • The permit holder must produce to the Council, prior to the site use, a copy of the insurance policy to be taken out under this permit. 
  • The permit holder must inform the Council immediately of any incident that may result in a claim against the permit holder or the Council. 
  • If any of these General Conditions are not complied with then this office will revoke the permit. 

Public Liability Insurance

Insurance is required for all permits listed on the reverse of this application. 

Obligation to insure: The permit holder shall, at all times during the Agreement Term, be the holder of a current Public Liability Policy of Insurance (“The Public Liability Policy”) to cover legal liability to third parties for personal injury or property damage as a result of an occurrence in connection with the business of the insured, as specified in the public liability policy/Annexure in the name of the Permit Holder providing coverage for an amount of at least that stated in the Annexure. 

The Public Liability Policy shall extend to cover the Murrindindi Shire Council (the Principal) in respect to claims for personal injury or property damage arising out of the negligence of the Permit Holder. 

Indemnity:

The Permit Holder agrees to indemnify and to keep indemnified the Murrindindi Shire Council, its servants and agents (the Principal), and each of them from and against all actions, costs, claims, charges, expenses, penalties, demands and damages whatsoever which may be brought or made or claimed against them, or any of them, in connection with the Permit Holders performance or purported performance of its obligations under this Contract and be directly related to the negligent acts, errors or omission of the Permit Holder. 

The Permit Holders liability to indemnify the Murrindindi Shire Council shall be reduced proportionally to the extent that any act or omission of the Murrindindi Shire Council, contributed to the loss or liability.

Local law permit - street trading activity application

Application for a Street Trading and A-Frame signage permits expiring 30 September 2024.

Application fees apply for a Street Trading Permit and must be paid at the time of lodgement of the permit application. 

You may be eligible for a full fee exemption if your business sells food.

A complete permit application may take up to 28 days to process and issue.

Council at its discretion may release details contained in your application to adjoining landholders. 

If issued, this permit may become a public document.

General conditions:

Permit conditions:

  • The application is for the area of footpath abutting the property of the applicant business or organisation only.
  • There is no street furniture, goods, planter boxes or signage located outside the Trading Zone.
  • While in use, street furniture and signage must:
i. Be the appropriate distance from the roadside curb (an area where vehicles may stand).
ii. Provide a minimum unobstructed path of travel of 1800mm from the building line.
iii. Provide a set back of 0.5 meters within the Trading Zone from each boundary of a premises to ensure access points from the footpath to the road are retained between each premises.
  • Street furniture and signage must be kept safely secured in place.
  • Lighting will not be used on or with the street furniture or signage.
  • There are no movable parts on or attached to, the street furniture or signage (e.g. flags, balloons etc…).
  • Street furniture and signage can only be on the footpath while the business is open and attended.
  • A maximum of two A-frame signs and two teardrop banners per applicant business/organisation will be permitted.
  • A-frame signage does not exceed 900mm high and 600mm wide.
  • Comply with all conditions in the Street Trading and Designated Roads Guidelines.
  • That you hold and supply to council, a current Public Liability insurance of at least $20,000,000 for the entire duration of the permit.
Failure to comply with any of the permit conditions may result in the cancellation of the permit or a Penalty Infringement Notice being issued.
